The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the petitioner for seeking parole for a period of two months. Status report is on record. Factum of surgery of petitioner's wife is confirmed. 2.

Nominal Roll dated 26.01.2018 reveals that the petitioner was convicted under Sections 302/392 IPC and was sentenced to undergo RI for life imprisonment with fine `100/-. Crl.A.327/2002 was dismissed by this Court on 23.05.2007. Nominal Roll further reveals that the petitioner has already undergone twenty one years, nine months and twenty-six days incarceration besides remission for four years and nine months as on 25.01.2018. It further reveals that he is

not involved in any other criminal case. Earlier he was granted parole / furlough on various occasions and there are no allegations of its misuse.

In the interest of justice and for the reasons mentioned in the writ petition, the petitioner is granted three weeks parole from the date of his release, on his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the Trial Court. After completion of parole period, the petitioner shall surrender before the Jail Superintendent.
