% 23.05.2019 In the above captioned two applications, petitioners seek regular bail in FIR No. 406/12 under Sections 302/376(2)(g)/306/506/34 of IPC, registered at police station Bawana, Delhi.
Since these two applications arise out of one FIR, in which trial has fairly progressed, therefore this Court is not inclined to pre-judge the evidence already recorded.
It is informed that the evidence of 33rd witness out of 34 witnesses was recorded on 30th May, 2017 and thereafter, it has been deferred on one ground or another and that petitioners-Shyam Lal and Seema are in custody for the last five and six years respectively. In the facts and circumstances of this case, it is deemed appropriate BAIL APPLN. 353/2019 & 967/2019
to dispose of these applications, with direction to trial court to expedite the recording of evidence and in any case, to conclude the trial in this case within this calendar year.
Trial court be apprised of this order forthwith, to ensure its compliance. Both the applications are disposed of, while not commenting on the merits of this case.
