Issue notice to the respondent.

Mr. Asheesh Jain accepts notice on behalf of the respondent i.e. Directorate General of Training (DGT).

In view of the directions that I propose to pass, Mr. Asheesh Jain says that, for the moment, no counter affidavit needs to be filed. 4.

Broadly, the grievance of the petitioner is that despite the fact that it had given intimation to DGT that it was functioning from the new premises located at Dev Vihar, Gurjaro Kabas, Goner Road, Tehsil Sanganer, Jaipur, Rajasthan, no inspection has been carried out, resultantly, the affiliation which has to be accorded qua its new premises has not been granted. 5.

Besides this, it is also the petitioner's grievance that the petitioner's access to DGT's NCVT MIS portal has been blocked.

It is the petitioner's say that on account of this circumstance which occurred in and about 21.11.2019, the data concerning the students admitted to the "Electrician Trade" as well as "Fire Technology and Industrial Safety Management Trade" could not be uploaded.

The petitioner claims that the data, inter alia, relates to attendance and internal assessments made qua the students admitted to aforementioned trades.

To be noted, it is the petitioner's assertion that insofar as the Electrician Trade is concerned, it was granted affiliation by the DGT on 08.09.2014 and likewise, as regards Fire Technology and Industrial Safety Management Trade, it was accorded affiliation on 16.09.2016. 9.

These affiliations, according to the petitioner, were granted qua the premises located at Purani Chungi, Agra Road, Jaipur. The petitioner, it appears, had taken the said premises on rent. 10.

As noted above, the petitioner has moved to the new premises which, according to the petitioner, has not been inspected and affiliation sought, vis-à-vis the said premises, has not been granted. 11.

The petitioner claims that even though it made an application to the DGT for grant of affiliation qua the new premises as far back as on 05.08.2018, there has been no movement in the matter. 12.

Given the aforesaid backdrop, the captioned writ petition is disposed of with the following directions:

(i) The DGT will treat the captioned writ petition as a representation. The DGT will deliberate upon the same as well as the application dated

05.08.2018 and render its view in the matter. (ii) If necessary, the DGT will also carry out an inspection of the new premises.

(iii) Pending the aforesaid exercise, the DGT will grant the petitioner, access to its NCVT MIS portal. The needful will be done within one week from today.

(iv) Needless to add, the direction contained in sub paragraph (iii) above will be subject to the final result of the deliberations carried out by the DGT. 13.

It is made clear that nothing said hereinabove will impact the final order that the DGT is required to pass qua the petitioner's representation. 14.
