% 13.01.2016 Vide this petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C, the petitioner seeks parole for a period of one month in order to reunite the social ties with family and society.
Notice.
Mr Rahul Mehra, learned Standing Counsel for the State accepts notice and submits the status report verifying the address of the petitioner. It is submitted by counsel for the petitioner that earlier also the petitioner was granted parole twice and never misused the same. Learned Standing Counsel for the State submits that the prosecutrix is also residing near the vicinity of the petitioner. However, he has no objection to the grant of parole to the petitioner.
A perusal of nominal roll of the petitioner goes to show that the petitioner has been in jail continuously for 12 years and 2 months. His overall conduct has been reported to be satisfactory. He was twice granted parole and he did not misuse the same. Under the circumstances, the petitioner is granted parole for a period of four (4) weeks, which will be effected from the date of his release, on his furnishing personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction
concerned Trial Court. However, he is directed not to contact the prosecutrix or any of her family members. He is further directed to report to the concerned SHO, P.S. Jahangir Puri on every Monday at 10:00 am during this period. Petitioner be informed through the Superintendent Jail. Copy of the order be also sent to SHO, Police Station Jahangir Puri for information.
Petition stands disposed of accordingly.
