% 12.02.2019 It is submitted that petitioner and respondent no. 2 have settled their disputes amicably vide Memorandum of Understanding dated 24/01/2019, therefore, present FIR No. 576/2016 under Sections 420/467/468/471 IPC registered at police station Malviya Nagar may be quashed. Respondent no.2 is present in Court and has been identified by SI Ved Prakash of police station Malviya Nagar. He submits that he has settled the matter with petitioner of his own free will and without any undue force, pressure or coercion, inasmuch as, received entire settled amount of `90,000/- from the petitioner. He further states that he has no objection in case the FIR and the consequent proceedings are quashed. Affidavit of respondent no.2 is also on record.
Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
