This petition has been filed with the following prayers:- "a) Issue writ of certiorari, mandamus or any other similar nature while directing the Respondents to grant the benefit of 2nd ACP scheme to the Petitioners in accordance with the original ACP scheme of 1999 on the due date when the Petitioner completed 24 years regular service in BSF reckoning their initial date appointment as constable (GD) in BSF; b) Direct the Respondents to grant the benefit of 3rd MACP when the Petitioners completed 30 years in regular service in BSF on due date reckoning their initial date appointment as constable (GD) in BSF;
c) Consequently, direct the Respondents to clear all the arrears in terms of prayer (a) to (b);
d) Pass such further and other order/s as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."

This learned counsel for the petitioners seek the benefit of the judgment of this Court in the case of Suresh Kumar and Anr. v. Union of India and Ors., W.P.(C) 11267/2021 decided on 06.03.2025, wherein this Court had relied upon the judgement of a Coordinate Bench of this Court in the case of Om Prakash & Ors. v. Union of India & Ors., W.P.(C) 388/2015, decided on 29.01.2016.

Though, the learned counsel for the respondents would submit that the matter is under examination with the respondents, appropriate shall be that the writ petition be treated as a representation on behalf of the petitioners and a decision thereof, be taken within six weeks from today. 6.
While, deciding the petition as a representation due consideration shall be given to the judgments rendered by this Court (as referred above) while passing a speaking and a reasoned order. 7.
If the petitioners are aggrieved by the order to be passed, the petitioners shall be within his right to approach the Court in accordance with law.

If the respondents decide to grant the benefit to the petitioners, the same shall be implemented within a period of four weeks of the passing of the order.

The petition is disposed of.
