The present Suit has been filed by the Plaintiff seeking specific performance of the Agreement to Sell dated 02.08.2018. 2.
During the pendency of the present Suit, the parties have entered into a settlement vide a Settlement Agreement. Though there is no date mentioned in the Settlement Agreement, the Stamp Paper has been purchased on 23.09.2025. The Settlement Agreement is being reproduced as under:

The Plaintiff i.e. Mr. Ashu Aggarwal has joined the proceedings through video conferencing. Learned Counsel for the Plaintiff has identified the Plaintiff. The Power of Attorney - Mr. Raj Kumar Gupta is also present in Court today.

The Defendant i.e Mr. Manish Vij is also present in Court today and the learned Counsel for the Defendant has identified the Defendant. 5.
Both the Plaintiff and the Defendant state that they have understood the contents of the Settlement Agreement and are prepared to abide by the Settlement Agreement.

This Court has gone through the Settlement Agreement which is legal and lawful.

In view of the fact that settlement has been arrived at between the Parties, the Suit is disposed of in terms of Order XXIII Rule 3 of CPC and the Settlement Agreement entered into between the Parties. 8.
Pending applications, if any, also stand disposed of. 9.
Let the Decree Sheet be prepared accordingly. 10.
The Parties shall be bound by the terms of the Settlement Agreement. 11.
The Court Fee be refunded in accordance with Section 16 of the Court Fees Act, 1870.
