% 28.08.2020 This matter is being heard through video-conferencing. IA 7444/2020 This is a joint application filed by the plaintiff and the defendant under Order XXIII Rule 3 and Order XXIII Rule 1 read with Section 151 CPC with the following prayers:

"It is therefore, most respectfully prayed that this Hon'ble Court may be pleased to:

a. Allow the Plaintiff to withdraw the present suit in terms of the compromise terms arrived at between the parties in terms of Clause 5 hereinabove;

b. Pass any such other or further order that this Hon'ble Court may deem fit in the facts and circumstances of the case" The application is signed by the plaintiff as well as the defendant and their counsel and is accompanied by the affidavit of the plaintiff as well as the defendant.

Suffice it would be to state that the plaintiff and the defendant have

settled their inter se disputes in terms of Para 5(a) to 5 (e) of this application. Parties who are present through video conferencing and identified by their counsel and their counsel states, they / parties shall be bound by the terms of the settlement. Their statements are taken on record. In view of the above, learned counsel for the plaintiff states, the suit be treated as dismissed as withdrawn. It is ordered accordingly. The application is disposed of.
