% 15.02.2019 The present appeal is directed against the order dated 14.01.2019. Admittedly, even prior to passing of the order, the application under Section 12 of the Guardianship & Wards Act, 1890, which was moved by the applicant/father (appellant herein), had become infructuous. Mr. Suri, learned Senior counsel appearing for the appellant, submits that substantive petitions are still pending before the Family court and he submits that any observation made for the purposes of deciding this application should not come in the way of the appellant at the time of hearing of the substantive petitions, which are pending disposal before the same Court.
While there is no reason to entertain this appeal, since the impugned order has, admittedly, become infructuous, we make it clear that any observations made, would be treated as observations with respect to the
application which has been decided and the pending matters would be decided on their merits, after hearing counsel for both the parties. In case any interim application is filed seeking interim relief, Family Court would consider the same in accordance with law. The appeal is disposed of.
