Petitioner seeks regular bail in FIR No. 21/2013 under Sections 364/302/201/120-B/34 of the IPC registered as Police Station Ranhola.

Status report filed and the same is taken on record. 3.

Learned counsel for the petitioner submits that in case directions are issued to the trial court to expedite the recording of the prosecution evidence, he shall not press the application at this stage. Learned counsel further submits that the trial is not progressing as the Investigating Officer is not stepping into the witness box. 4.

Keeping in view the fact that 13 out of 17 prosecution witnesses have already been recorded and only the Investigating Officer and other formal/official witnesses remains to be examined, BAIL APPLN. 365/2019

trial court is directed to expedite the proceedings and endeavour to conclude the recording of the prosecution evidence within a period of three months from the next date of hearing before the trial court. 5.

Learned Addl. PP assures the Court that the Investigating Officer shall not seek unnecessary adjournments and shall appear before the trial court for his deposition as and when so directed by the Trial Court. The statement is taken on record. 6.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.

The petition is accordingly dismissed as withdrawn with the aforesaid directions.
