This application has been filed seeking condonation of delay of 304 days in filing the present appeal.

In view of the facts and circumstances stated in the application, delay is condoned.

This appeal has been filed for enhancement of the compensation granted vide Award dated 25th January 2025 passed by Motor Accident Claims Tribunal, Rohini Courts, Delhi ('MACT/Tribunal') in MACT The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

No.189/2020 at Rs.5,00,000/- in respect of the accident which occurred on 13th February 2020.

Mr. Anshuman Bal, counsel for appellants, contends that the only issue is with respect to the interest, which was granted at 9% per annum from the date of the award till its realization subject to the Insurance Company's depositing compensation in 30 days from the date of the award, rather than from the date of the filing of the claim petition till its realization. 3.

The relevant part of the directions of MACT is extracted as under: 4.

No doubt, the Tribunal has been amiss in not granting the interest from the date of filing. The idea of the interest is that if the compensation had been given to the claimant when the accident occurred or soon thereafter, he would have been duly compensated, but the delay in proceedings triggers necessary directions for payment of interest.

Accordingly, the MACT's award is modified to the extent that interest at the rate of 7.5% per annum from the date of filing of the claim petition till its realisation is awarded in favour of the claimant on the compensation of Rs.5,00,000/-.

amount shall be deposited within a period of four weeks before the MACT. 7.

The said amount, along with interest, be disbursed to the appellants, who are parents of the deceased, in equal proportions. 8.
