Respondent No.2 (CCL accused) was granted bail by the Sessions Court on 26th June, 2024 in FIR No. 225/2024, subject to certain conditions. The Petitioner (victim) alleged breach of bail conditions and filed an application for cancellation of bail before the Trial Court. However, the Trial Court did not consider the application, citing lack of requisite certificates under Section 65B of the Indian Evidence Act, 1872 to authenticate the photographs annexed in support of their averments. Accordingly, the Petitioner has approached this Court seeking cancellation of Respondent No.2's bail.

Counsel for Petitioner contends that he can file appropriate certificate before the Trial Court. and threatening the victim's family.

In light of the above, without going into the merits of the case, the present petition is disposed of with liberty to the Petitioner to apply, before the Trial Court, for seeking cancellation of bail by furnishing all the proof along with the requisite affidavits.

If and when such an application is filed, the same shall be considered by the Trial Court, on its own merits, in accordance with law. 5.

All rights and contentions of the parties are left open. 6.

Disposed of, along with pending application.
