The present petition under Article 227 of the Constitution of India has been filed for setting aside the impugned order dated 02.11.2023 passed by the learned Principal District and Sessions Judge ("PD&SJ"), Patiala House Courts, New Delhi, in case bearing no.544/2023 titled as "Vipal Kumar Farmah and Anr. vs. Manmeet Sumra Chonker", whereby the learned PD&SJ has transferred the case from the Court of learned District Judge, Commercial Court to the Additional District Judge, Civil Court. The petitioner herein is the defendant before the learned Trial Court. 2.

The learned counsel for petitioner seeks permission to withdraw the present petition on technical grounds and submits that a fresh petition may be filed after removal of the defects.
