% 31.01.2020 CM No.4029/2020 (Exemption) Allowed, subject to all just exceptions.

W.P.(C) 1204/2020 This petition challenges the order dated 22.01.2020 passed by the Appellate Authority under the Delhi Maintenance and Welfare of Parents and Senior Citizen Amended Rules, 2010 in appeal bearing no. PA/Appeal No. 197/2019/555-557, remanding the complaint of the petitioner back to the District Magistrate (North-West) to dispose of the same within eight weeks from the date of issuance of the said order. Having perused the contents of the petition and various orders annexed therein, it is quite evident that the District Magistrate is not performing the duty vested in him under the Rules and this has led to

unnecessary delay in adjudication of the complaint filed by the petitioner. The learned counsel for the respondent no.1, who appears on advance notice, assure this Court that this time the District Magistrate shall consider the complaint of the petitioner on merits and in accordance with the law and after hearing both the parties, shall dispose of the same within the period of four weeks from today.

In view of the statement made, at this stage I do not find it appropriate to interfere with the Impugned Order.

The petition is disposed of in the above terms, with no order as to cost.
