Mr. Sikhar Garg, Advocate, states that in terms of his statement recorded before the Joint Registrar on 20.05.2024, he seeks permission of this Court to withdraw the present suit with liberty to take resort to appropriate legal proceedings.

Learned counsel for the defendant has no objection to the aforesaid withdrawal and grant of liberty. He states that defendant had raised objection in the written statement with respect to existence of an arbitration clause between the parties and non-maintainability of the suit. 3.

Accordingly, the prayer of the plaintiff is allowed and the present suit is dismissed as withdrawn reserving liberty to the plaintiff to avail its remedy before the appropriate forum in accordance with law.
