This petition under Section 438 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed impugning the order dated 13.12.2024 passed by the Family Court, Saket, New Delhi in Mt. No. 148/2024 titled Tanima Das v. Vinod Maxim Benis, whereby the hearing on the application seeking interim maintenance has been fixed on 27.03.2025. 2.

Learned counsel for the Petitioner states that a direction be issued to the Family Court to hear the matter and grant interim maintenance to the Petitioners herein on 27.03.2025.

This Court notes that the impugned order was passed by the Family Court on 13.12.2024 and the present petition has been filed only on 28.02.2025 i.e., 2 1⁄2 months after the impugned order was passed. Today is the first listing of the petition.

The petition is without any merits and frivolous and no ground is made out for issuing any directions. The petition is dismissed along with pending application.
