% 13.03.2020 This petition has been filed by the petitioner under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator. Ms. Padma Priya, learned counsel appearing for the respondent / NHAI states she has no instructions and left it to the court to pass appropriate orders. She concedes to the fact that there is a dispute between the parties and the same has to be adjudicated. If that be so, this Court appoints, Justice G.S. Sistani, a retired Judge of this Court as the Arbitrator, who shall adjudicate the disputes and differences between the parties. The fee of the learned Arbitrator shall be regulated by the provision under the Fourth Schedule to the Arbitration and Conciliation Act.
