By way of the present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in connection with FIR No. 343/2022 dated 24.05.2022, registered at Police Station Krishna Nagar under Sections 307/34 of the Indian Penal Code, 1860, and Sections 25/27/54/59 of the Arms Act, 1959.

After some arguments, Mr. Lakshay Joshi, learned counsel for the applicant, seeks permission to withdraw the present application without prejudice to the rights and remedies available to the applicant in the pending criminal proceedings. He further submits that the trial before the learned Trial Court be proceeded with expeditiously. 3.

Mr. Tarang Srivastava, learned Additional Public Prosecutor for the State, assures the Court that no unnecessary adjournments shall be sought on behalf of the prosecution, and that the prosecution shall extend its cooperation for expeditious progress of the trial. 5.

The bail application, and pending applications, is dismissed as withdrawn, in terms of the above submissions. 6.

It is clarified that this Court has not expressed any opinion on the merits of the case or on any application that may hereafter be filed by the applicant, and the same shall be considered by the appropriate Court independently, on its own merits and in accordance with law.
