The order dated 11.01.2023, passed by the learned Chief Metropolitan Magistrate, dismissing an application filed by the petitioner under Section 156(3) of the Code of Criminal Procedure, 1973 ('CrPC'), is revisable under Section 397 of the CrPC, before the learned Court of Sessions.

In view of the above, the present petition is dismissed with liberty to the petitioner to file an appropriate petition before the learned Court of Sessions.

If any such petition is filed within a period of two weeks, the learned Court of Sessions is directed to consider the same without being influenced by the delay caused in filing the same, since the petitioner was pursuing the present petition before this Court.
