% 13.02.2019 The learned Additional Public Prosecutor points out that the allegations and the evidence that has been gathered so far show that the photocopy of a Will dated 07.08.1990 was used for mutation of the lands, the said Will being prima facie forged and fabricated and in this view the revenue department was also one of the victims of the offence of cheating, which matter required deeper probe.
The attention of the learned counsel for the petitioners is drawn to the ruling of the Supreme Court in Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karmur and Others v. State of Gujarat and Another, (2017) 9 SCC 641.

After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be permitted to withdraw the captioned petitions and the applications filed therewith. The petitions and the applications filed therewith are dismissed as withdrawn.
