By way of present petition filed under Section 397/401 Cr.P.C. read with Section 19(4) of the Family Courts Act, 1984, the petitioner seeks to assail the order dated 24.11.2023 passed by the learned Family Court, North East, Karkardooma Court, Delhi in MT 283/2021, vide which the petitioner has been directed to pay Rs.7,500/- as ad-interim maintenance to respondent till further orders.

Considering that the interim maintenance application is pending consideration and vide the impugned order, only ad-interim maintenance has been granted, the petition is disposed of with the direction that as and when the interim maintenance is fixed, based on income affidavit and other materials placed on record, the respondent shall be entitled to adjustment of arrears either way.

The Family Court shall make an endeavour to consider the application for interim maintenance at the earliest.
