This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal to complete the arbitral proceedings and pass the Arbitral Award. 2.
Disputes having arisen between the parties in relation to an Order Procurement Commission Agreement dated 01.03.2018, this Court appointed a Sole Arbitrator to adjudicate the disputes vide order dated 29.08.2022 in ARB. P. No. 1246/2021. It is stated in the petition that the evidence stands concluded in the arbitral proceedings and final arguments have to be heard by the learned Sole Arbitrator. In this backdrop, Petitioner seeks extension of the mandate of the Arbitrator by 04 months from 24.04.2025 when the mandate expired.

Mr. Rajendra Beniwal, learned counsel appearing on behalf of the Respondent, on instructions, submits that Respondent has no objection to the extension of the mandate of the learned Tribunal by a period of 04 months. 4.

arbitral proceedings are at the stage of final arguments, mandate of the Arbitral Tribunal is extended by a period of 04 months from 24.04.2025 and period from 17.09.2024 to 23.04.2025 is regularised. 5.
Petition is allowed and stands disposed of in the aforesaid terms.
