The present writ petition under Article 226 of the Constitution of India seeks to assail the order dated 21.03.2023 passed by the learned Central Administrative Tribunal in O.A.1965/2017 and other connected O.As.

A perusal of the impugned order shows that the original application filed by the petitioner/applicant was, with the consent of the learned counsel for the parties, disposed of in terms of the orders passed in O.A.1970/2017 by the learned Tribunal.

The present petition has now been filed on the premise that the issue raised in O.A.1965/2017 was not similar to that raised in O.A.1970/2017 and therefore the impugned order is liable to be set aside. 4.

the petitioner ought to have first approached the learned Tribunal for seeking review of the impugned order.

When faced with this situation, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file a review petition before the learned Tribunal.

In the light of the aforesaid, we dismiss the writ petition by making it clear that in case a review petition is filed by the petitioner within two weeks from today, the same will not be rejected on the ground of delay and will be considered by the learned Tribunal on merits.
