O R D E R

The petitioner has filed the present petition, inter alia, praying that the petitioner be released on regular bail in FIR No.0492/2017 under Section 376 IPC registered with PS Nihal Vihar. The petitioner has been in custody since 28.08.2017.

The said FIR was registered at the instance of the complainant. She has alleged that she was engaged to be married to the petitioner and while she was so engaged to him, she had visited his residence on 23.04.2017 where he had forcibly established physical relationship with her. She has stated that she did not make any complaint at the relevant time, as she was given to understand that she and the petitioner would be married. She alleges that, thereafter, the petitioner had taken her on a tour and also established physical relationship with her.

The petitioner, on the other hand, claims that after the engagement,

there were differences between the petitioner and the complainant and in view of the said differences, he had decided not to get married to the complainant.

Considering the controversy in this petition and considering that the material witness (complainant) has been examined, this Court is of the view that the petitioner ought to be released on bail. 5.

Accordingly, the petition is allowed and the petitioner is directed to be released on bail on him furnishing a Personal Bond in the sum of ₹25,000/- and a surety of an equivalent amount to the satisfaction of the concerned Trial Court.

This is also subject to the petitioner complying with the following further conditions:

a) The petitioner shall not contact either directly or indirectly the complainant or any of the witnesses.

b) The petitioner shall appear before the Trial Court on all hearings. c) The petitioner shall not leave the National Capital Territory of Delhi without prior approval of the trial court.

The petition is disposed of in the aforesaid terms. 8.
