This order is in continuation of the earlier order dated 26th October, 2016.

Though Mr. R. Sasiprabhu, Advocate has not appeared today also but Mr. Ajay Kumar Jha and Mr. Raghu Chandra, Advocates today appear for the plaintiff and have in Court handed over the printout of an email dated 13th September, 2016 and a copy of the order dated 14th January, 2016 in Ex.P. No.85/2010 filed by the plaintiff against the defendants herein and state that this suit for recovery of money is being withdrawn as the plaintiff has been unable to execute another money decree against the defendants. 3.

The counsel for the defendant No.2 presses for costs contending that the plaintiff has dragged the defendants in this suit for the last twenty years. 4.

However, the counsel for the defendant No.2, on enquiry, whether the defendants have any assets, is not willing to give any particulars. CS(OS) No.1567/1997

In this view of the matter, no ground for imposing any costs is made out.

The suit is dismissed as withdrawn.

No costs.
