The present petition has been filed under Articles 226 and 227 of the Constitution of India, inter alia, challenging the impugned Order-in-Orginal dated 16th August, 2024 passed by the Commissioner of Customs, T-3, Indira Gandhi International Airport, New Delhi.

The case of the Petitioner is that on 8th June, 2024 the Petitioner was intercepted by the Customs Department when he had arrived at Terminal-3, IGI Airport, New Delhi from Hong Kong. The Petitioner was wearing a Gold Bracelet which was detained by the Customs official vide detention receipt No. 004597 dated 08th June, 2024.

According to the Petitioner, the detained jewellery was his personal jewellery and was purchased from Mohan Jewellers, Chennai on 30th The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. January, 2018. Further, the Petitioner is stated to have been forced to sign a standard form waiver of show cause notice and personal hearing. 5.

The Order-in-Original has been passed in this matter, the same is placed on record. After having perused the jewellery bills which have been placed by the Petitioner, it appears that the Petitioner ought to be given an opportunity to file an appeal against the Order-in-Original dated 16th August, 2024. 6.

Considering the fact that the present writ petition was pending before this Court, the Petitioner is permitted to file an appeal challenging the impugned order dated 16th August, 2024 within thirty days. 7.

If the items have not been sold, the customs shall not dispose of the items.

If the Petitioner wishes to avail of the order for release of the goods, he may approach the appellate authority.
