The present petition under Article 226 of the Constitution of India read with Section 482 of the Cr.P.C. seeks the following prayers: "a. Issue a writ in the nature of Mandamus directing the Respondent to release the Petitioner on Parole for a period of three months; b. Pass any other order or further orders, which this Hon'ble Court deems fit and proper in the interest of justice;" 4.

that vide order dated 20.12.2023, in W.P.(CRL) 3196/2023, a coordinate bench of this Court had granted furlough for a period of 03 weeks to the petitioner, which was further extended vide order dated 06.02.2024, in the said petition. It is further pointed out that after expiry of the same, the petitioner had duly surrendered without misusing the liberty granted to him. 5.

Status report dated 07.03.2024, authored by Insp. Satish Kumar, SHO, P.S. Naraina has been handed up in Court today and the same is taken on record, wherein, the factum of petitioner's wife's pregnancy has been verified by the concerned Hospital and the expected date of delivery is mentioned as 22.03.2024.

In view of the above, the petitioner is directed to be released on parole for a period of 02 weeks from the date of his release, on his furnishing a personal bond in the sum of Rs. 20,000/- with one surety of like amount to the satisfaction of learned Trial Court/Link Court, further subject to following conditions:

i) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

ii) Petitioner shall provide his mobile number to the Investigating Officer concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

iii) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with any of the witnesses. 7.

Upon expiry of the said period of two weeks, the petitioner shall surrender before the Jail Superintendent.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance.
