The applicant seeks interim bail in connection with FIR No. 36/2018 dated 28.01.2018, registered at Police Station Kirti Nagar, District West, under Sections 363/366/344/370/354/354A/120B/34 of the Indian Penal Code, 1860 and Section 8 of the Protection of Children from Sexual Offences Act, 2012, in order to travel to Chennai for the wedding of his son.

Issue notice. Notice is accepted by Ms. Manjeet Arya, learned Additional Public Prosecutor, on behalf of the State. 3.
The applicant had very recently made applications for interim bail and extension of interim bail on the ground of his medical condition. The said applications were allowed, and the applicant was granted interim bail on medical grounds by the Court from 30.01.2026 to 21.02.2026 (BAIL APPLN. 4344/2025) and 26.02.2026 to 15.03.2026 (BAIL APPLN. 771/2026). In BAIL APPL. 771/2026 he had also raised the ground of his son's wedding and sought permission to travel to Chennai. Noticing the inconsistency between the medical case pleaded by the applicant and the request to travel for this occasion, and the medical advice on record with regard to the applicant's travel, this Court had observed in the order dated 26.02.2026 as follows:
"9. Having considered the medical reports and the submissions made, I am of the clear view that the applicant's request for permission to travel to Chennai to attend his son's wedding is medically contraindicated and, in any event, wholly inconsistent with the medical grounds urged by him in support of his application for interim bail." 5.
The applicant nonetheless approached the Sessions Court for permission to travel to Chennai, which was rejected by order dated 17.03.2026, and has now approached this Court for the same purpose. 6.
In view of the reasons already stated in the aforesaid orders, Mr. Arjun Singh, learned counsel for the applicant, seeks permission to withdraw the present application.

At this stage, it is also pointed out by Mr. Hitesh Vali, learned Additional Public Prosecutor for the State, who is present in Court, that the applicant had filed an application (BAIL APPL. 1014/2026) for extension of interim bail granted by order dated 26.02.2026. The application sought extension until 01.04.2026, a period which would have covered the period of the applicant's son's wedding, although that ground was not taken therein. The application was listed on 13.03.2026 before a coordinate Bench, and was dismissed as withdrawn. Curiously, the latest application has not even been mentioned in the present bail application. The case is thus one of clear suppression, where a prior bail application - that too, one filed only one week ago - has not been disclosed to the Court, and the order dated 13.03.2026 passed therein has also not been disclosed. The Court is compelled, in these circumstances, to impose an order of costs.

The application is dismissed as withdrawn, with costs of Rs. 25,000/- to be deposited with the Delhi High Court Bar Association Costs Account [A/c No. 15530110179338; IFSC No. UCBA0001553; UCO Bank, Delhi High Court Branch] within a period of one week from today, in addition to the costs imposed by the learned Sessions Court vide order dated 17.03.2026.
