Petitioner seeks quashing of FIR No.159/2014 under Sections 229/337/338 IPC PS Connaught Place.

Subject FIR was registered consequent to an accident caused by the petitioner on account of alleged rash and negligent driving. The complainant's vehicle was damaged.

Parties have settled their disputes. The petitioner had agreed to pay Rs.55,000/- as full and final settlement towards the damages caused to car as well as minor injuries alleged to be sustained by the complainant. Rs.30,000/- has already been paid by the petitioner to the complainant. Balance amount of Rs.25,000/- is paid by the petitioner to the respondent No.2, in cash, in court today.

Respondents No.2 to 4 are present in court in person. Respondent CRL.M.C. 5340/2017

No.4 is represented through counsel who is the son of respondent No.3 and also the Special Power of Attorney holder.

They submit that they have settled the disputes with the petitioner and do not wish to press the criminal complaints against the petitioner any further. 5.

In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace and harmony are restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom. 6.

Keeping in view the nature of the allegations, I am of the view that the petitioner should be directed to perform some traffic duty to assist the Traffic Police in and around Connaught Place areas so that he is more careful in future while driving. Accordingly, the petitioner shall report on 27.04.2018 at 10:00 am at P.S. Connaught Place wherever he shall be deputed to assist in traffic management for a period of two hours. The petitioner shall perform traffic duty for a total of five days. The concerned Traffic Inspector shall depute the petitioner on four more days keeping in view the working hours of the petitioner in mind. 7.

In view of the above, FIR No. 159/2014 under Sections 229/337/338 IPC PS Connaught Place and the consequent proceedings emanating there from are quashed.
