O.M.P.(MISC.)(COMM.) 8/2018 This is a petition under Section 29-A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of time for making of the Award by the Arbitral Tribunal hearing the disputes between the parties. Learned senior counsel for the respondent appears on advance notice and submits that he has no objection if the time for making the Award is extended up till 22.06.2018. He further submits that the same should be without prejudice to the rights and contentions of the respondent to challenge the Partial Final Award passed by the Arbitral Tribunal.
In my opinion, the extension of time cannot prejudice the rights of the respondent to challenge the Partial Final Award. In view of the above, time for making the Award by the Arbitral Tribunal is extended for the period of six months till 22.06.2018. The petition is allowed in the above terms.
