% 22.04.2019 By this petition filed under Section 438 of Cr.P.C. read with Section 482 Cr.P.C, the petitioner seeks anticipatory bail in FIR No.501/2018 under Sections 376/328/506 IPC registered at Police Station Nangloi, Delhi. Cross cases have been filed by the ladies of two families against the male members of the others and interim relief was granted to the petitioner on 14.02.2019 by this court.
Status report has been filed, as per which, the petitioner has already joined investigation and is not required for custodial interrogation. Keeping in view the facts and circumstances of the case, it is hereby directed that in the event of arrest till filing of the chargesheet, the petitioner, Kamal Kumar be released on bail on the following terms and conditions:- (i) That the petitioner shall furnish a personal bond in the sum of Rs.30,000/- with one surety of the like amount subject to the satisfaction of Arresting Officer/SHO concerned;
(ii) That the petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required;
(iii) That the petitioner will not influence the prosecutrix and the witnesses of the present case in any manner.
In case of default of aforementioned condition, the State is at liberty to take appropriate recourse in accordance with law. In view of the above, the petition is disposed of. Copy of this order be given dasti.
