Mr. Yadav, learned counsel appearing on behalf of Capt. V.K. Sharma states that Asia Aviation Limited has been struck off from the register of the company maintained by the Ministry of Corporate Affairs. 2.

Additionally, there is nobody appearing on behalf of M/s Asia Aviation Limited.

Mr. Yadav, learned counsel appearing on behalf of Capt. V.K. Sharma, seeks to withdraw the present petition with liberty to file execution petition to seek the amounts awarded in terms of the Award dated 24.07.2012.

The said liberty is granted.

Mr. Yadav, learned counsel has handed over an order dated 23.05.2025 in case titled "Late Capt. V.K. Sharma vs. ROC, NCT of Delhi & Haryana", wherein the NCLT has granted liberty to the petitioner to proceed against the Directors of M/s Asia Aviation Limited. 7.

Granting similar liberty to the petitioner to proceed for execution of the Award against the Directors, the present petition under Section 34 is dismissed as withdrawn.
