% 23.03.2026 1.
The present petition alleges wilful disobedience of the order dated 02.04.2025 passed by this Court in W.P.(C) 4088/2025. The said order reads as under:- "1. This public interest litigation petition has been filed with the allegation that on a land belonging to Delhi Development Authority (hereinafter referred to as 'DDA') which is a ground/open space at Jasola, Pocket-12 near Iqra Masjid, Delhi, certain fairs are being organised where many kinds of illegal activities are likely to take place. Accordingly, a prayer has been made to issue direction to the Authorities concerned to check such illegal activities and even stop the fair.
2. Learned counsel representing the DDA has tendered to the Court a letter dated 06.01.2025, where permission by DDA has been granted for organising a religious function, "Eid Milan Samaroh" from 26.03.2025 to 23.04.2025. The letter of permission dated 06.01.2025 is taken on record. There are various conditions imposed by the said letter including conditional permission for use of loud speakers, DJs and band etc., which is subject to various laws in force.

submitted that Beat and Division Staff have been deployed to keep a check.
4. In view of the aforesaid, we dispose of this writ petition with a direction to all the Authorities concerned to ensure the ground/open space permitted to be used by the DDA, shall be utilised by the Organisers only for the purpose for which the permission has been accorded and not for any other purpose.
5. The DDA is directed to ensure strict compliance of the terms and conditions of the permissions granted under letter dated 06.01.2025 and in case any violation is found, necessary action which may be warranted under law shall be taken by the DDA, against the Organisers.
6. We also direct the Delhi Police not only to ensure law and order is maintained in the area, but also that no criminal activities take place. It shall be the personal responsibility of the SHO concerned to ensure that no such untoward incident takes place and in case, any criminal or other activities are reported, appropriate action may be initiated by the Police as well.
7. In view of the aforesaid, the present writ petition stands disposed of." 2.
A perusal of the order indicates that the operation of the aforesaid order was confined for the purpose of the 'Eid Milan Samaroh' to be organized from 26.03.2025 to 23.04.2025. The said period is long over and the order has worked itself out.
3.
In the circumstances, it is untenable for the petitioner to file the present petition seeking wilful disobedience of the said order. 4.
If the petitioner has any grievance with regard to any unlawful activities being conducted in the ground / open space in question, he shall be at liberty to initiate appropriate proceedings in accordance with law. 5.
The petition is disposed of in the above terms. SACHIN DATTA, J MARCH 23, 2026/r The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 27/03/2026 at 11:34:56
