The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes between the parties under the Property Management Service Agreement dated 24.11.2022 (hereinafter referred to as "Agreement"). 2.

It is the case of the Petitioner that under the Agreement, the Petitioner was to provide Property Management and Facility Management Services to the Respondent.

It is stated that since disputes arose between the parties, the Agreement was terminated by the Petitioner on 27.09.2024. 4.

Clause 20.2 of the Agreement contains an arbitration clause by which the parties have agreed to get their disputes adjudicated through arbitration. The said clause specifically indicates that the venue of the arbitration shall be at Delhi.

A notice under Section 21 of the Arbitration and Conciliation Act, 1996, invoking arbitration was sent to the Respondent on 02.05.2025 which has not been replied to by Respondent. The Petitioner has, therefore, approached this Court by filing the present Petition. 7.

Notice in the present petition was issued on 20.03.2026. 8.

Mr. Vikas Padora, learned Counsel enters appearance on behalf of the Respondent.

In view of the fact that disputes have arisen between the Parties and the Agreement contains an arbitration clause at Clause 20.2, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties.

Accordingly, Mr. Balaji Srinivasan , Advocate (Mob. No. 9868120258) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre ["DIAC"] and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration and Conciliation Act, 1996, within two weeks from the date of entering into reference. All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to state, nothing in this Order shall be construed as an expression of this Court on the merits of the contentions of the parties. 15.

The Petition stands disposed of in the above terms, along with pending Application(s), if any.
