Apropos the order dated 18.12.2025, learned counsel for the petitioner seeks to withdraw the present petition. 2.
In view of the aforesaid, the petition is dismissed as withdrawn. 3.
It is clarified that the petitioner shall be free to move an appropriate application seeking an expeditious disposal of the eviction petition before the learned ARC, who shall be at liberty deal with the same in accordance with law, also as per the daily listing and pendency before him. 4.
Needless to say that the findings rendered by the learned ARC in the impugned order dated 29.11.2019 whereby the application seeking leave to defend of the tenant was allowed shall not have any bearing to the subsequent proceedings and the outcome thereof in Eviction Petition 61/2019.
