CM APPL. 7189/2019 For the reasons mentioned in the application, the delay of 20 days in filing the appeal is condoned and the application is disposed of. MAC.APP. 255/2019 Counsel for the appellant submits that in terms of impugned order dated 23.10.2018, he is ready to deposit the amount of Rs. 25,000/- under Section 140 without prejudice to the rights and contentions of the parties to be raised before the trial Court.

Looking into the facts and circumstances, the order dated 23.10.2018

is modified to the extent that nothing stated in the impugned order dated 23.10.2018 shall be read as a finding against the appellant and the appellant shall deposit the amount in terms of impugned order dated 23.10.2018 without prejudice to the rights and contentions of the parties before the trial Court within a period of four weeks. The trial Court shall proceed with the matter in accordance with law.

The appeal is disposed of accordingly.

The Demand Draft so deposit with the Registry be returned to the appellant.

A copy of this order be sent to the trial Court forthwith. As prayed, a copy of this order be given dasti under the signatures of Court Master.
