This petition is filed on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties.

Disputes between the parties emanate from a Purchase Order dated 29.08.2022 placed by the Respondent on the Petitioner. Petitioner pleads that the work was to be completed on a land of 14.5 km to be provided by the Respondent to the Petitioner. Part of the land being 1.5 km was provided by February, 2023 and Petitioner completed the work and gave possession to the Respondent on time. Between April, 2023 to November, 2023, 10 km land was provided in eight intervals but again Petitioner completed the work. Remaining land was never provided and even payments due to the Petitioner were not cleared by the Respondent. suffered a loss of about Rs.94 lacs. Since no payments were forthcoming, Petitioner invoked the arbitration clause 32 in the Purchase Order and sent an invocation notice.

Learned counsel appearing on behalf of the Respondent submits on instruction, that Respondent has no objection to the appointment of an Arbitrator by this Court as the existence of the arbitration agreement between the parties is not disputed.

Accordingly, with the consent of the parties, Mr. S.N. Gupta, Advocate (Mobile No. 9810077343), is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. Arbitration proceedings will be held under the aegis of Delhi International Arbitration Centre ('DIAC') and as per its Rules. Fee of the Arbitrator shall be as per the DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018. 5.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
