The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short 'the Act') for appointment of an arbitrator. 2.

The brief facts are that the respondent engaged the services of the petitioner, a construction firm for the Erection and Fabrication of Piling, UG and Civil/Structural Works for AVU Unit for Panipat Refinery Expansion Project (P-25) vide work order dated 01.11.2023 at the total cost of Rs.5,22,15,000/-. Disputes arose between the parties. Clause 14 of the work order provides for dispute resolution through arbitration. The petitioner vide legal notice dated 15.05.2025 under Section 21 of the Act invoked arbitration. Petitioner had filed a similar petition under Section 11(6) of the Act before the High Court of Punjab & Haryana which was dismissed as The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. withdrawn with a liberty to file a fresh petition before this court. Hence the present petition 3.

Learned counsel for the respondent on instructions has no objection for referring the matter to arbitration.

Accordingly, the petition is allowed by appointing Justice Ms. Reva Khetrapal (Retd.) (Mobile No.9871300030) as the sole arbitrator for adjudication of the disputes which have arisen between the parties. 5.

The fees of the learned Arbitrator will be governed by Schedule IV of the Act. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.

It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 7.

A copy of this order be forwarded to the learned Arbitrator for information.
