The accused/applicant seeks regular bail in case FIR No. 222/2023 of Police Station Hazrat Nizamuddin for offence under Section 307/34 IPC and Section 25/54/59 of the Arms Act.

Broadly speaking, according to the prosecution case, the accused/applicant fired at the injured Kamal and splinters of the said fired bullet also hit Raju. Fortunately, both of them survived, but Raju was not traced out by the investigator. Further, the gun allegedly, which got recovered from the accused/applicant did not match with the bullet allegedly recovered from body of Kamal. Furthermore, Kamal is stated to have given a signed statement to the IO, which is not on record. 3.

that the IO is deliberately helping the accused/applicant by creating loopholes in the investigation.

After addressing partly, learned counsel for accused/applicant seeks permission to withdraw this application with liberty to file afresh before the trial court after examination of the public witnesses, namely, Tanveer Alvi, Mehmood Khan and Sujan.

As requested, the bail application is dismissed as withdrawn with liberty as sought.
