% 07.02.2020 The present petition is filed under Section 482 Cr.P.C. seeking setting aside of impugned order dated 20.01.2020 passed in SC 423/2018 in FIR No. 89/2018 dated 26.02.2018, registered at Police Station Vikas Puri for offence punishable under Sections 307/328/392/397 IPC. It is stated in the present petition that the accused has been incarcerated for a period of almost two years and in a period of two years, out of 13 prosecution witnesses only 3 have been examined and thus it is evident from the pace at which the trial is going on that it will take time to conclude. Therefore, applicant/ accused had filed an application under section 309 CrPC and the same was dismissed for the reasons that more than 650 cases are pending in that court and day to day hearing of matter

might not be possible.

It cannot be disputed that the learned Trial Court is burdened with many cases and the present case is not one which would require day to day trial.

Accordingly, I expect the Trial Court to expedite the examination of prosecution witnesses and to decide this matter expeditiously. Order dasti.
