O R D E R

The petitioner has filed the present application seeking bail in connection with FIR No.0068/2019, under Sections 420/468 of the IPC, registered with PS Ghazipur.

The said FIR was registered at the instance of one Satpal (complainant). The complainant alleged that the petitioner had represented that he is an insurance agent and had induced him to get a third-party insurance of his vehicle through him. He alleged that he had paid ₹8,017/- in cash to the petitioner for insuring his vehicle bearing no. DL 1LL 8924. The said vehicle was involved in an accident and on 13.03.2016, an FIR bearing no.173/2016, under Sections 279/337 of the IPC, was registered with PS Vasant Kunj North.

He alleges that at that stage, he found that the policy bearing no. OG08-1101-1801-000285278 issued by Bajaj Allianj was forged.

It is stated that during the course of investigation another victim (Sopal) also produced an original insurance policy for a vehicle bearing no. DL 1LL 7471, which was found to be forged. He also alleges that the said policy had been purchased by him through the petitioner. 5.

It has been verified that 'Sopal' and 'Satpal' are cousins. 6.

The statements of the complainants were recorded and a chargesheet had been filed.

The petitioner has been in custody for more than four months.

The investigation is complete. In the given circumstances, this Court considers it apposite to allow the present petition. The petitioner would be released on bail subject to his furnishing a Personal Bond in the sum of ₹25,000/- and two sureties of an equivalent amount to the satisfaction of the Trial Court. He shall furnish his mobile number to the concerned SHO/IO and ensure that he is reachable on it at all times. The petitioner shall also mark his presence at the concerned police station (PS Ghazipur) on the first Monday of every calendar month.

The petitioner shall not contact the complainant or any of the proposed witnesses either directly or indirectly. 8.

The petition is allowed in the aforesaid terms. 9.
