% 15.02.2019 This petition seeks quashing of an FIR No. 57/2018 on the basis of a settlement. However, the prosecution's case is that a petrol station salesman was grievously beaten up at about 2.45 a.m. by the petitioner alongwith his cohorts, the nature of offence is alarming; it has led to disquiet in the neighbourhood, as well as threatened peace and law and order. The learned counsel for the petitioner relies upon the judgements of this Court in Ankit Sharma vs. The State & Anr. in W.P. (Crl.) 2012/2017 decided on 18.09.2017 and Ajay Kumar & Ors. vs. State (NCT of Delhi) 7 Anr. in W.P. (Crl.) 1617 of 2017 decided on 13.03.2018. However, the same would not be applicable to this case because the facts and circumstances are different.
In view of the above, the petition is dismissed as not maintainable, at this stage.
