1. The present writ petition has been filed with the following prayers:- <[a] Issue a writ of certiorari and quash the withdrawal order dated 03.01.2023 passed by the Respondent No.2 vide which the recognition of the Petitioner for D.El.Ed. Course has been withdrawn; and [b] Issue a writ of mandamus and direct the Respondent No.2 to issue restoration order in favour of the Petitioner for D.El.Ed course expeditiously and in a time bound manner; and [c] Pass any other and further order(s) as may be deemed fit.=

2. The petitioner has challenged the impugned order dated 03.01.2023 <Withdrawal Order= whereby the National Council for Teacher Education in exercise of power vested under Section 17(1) of the NCTE Act, 1993, the Southern Regional Committee with due recognition granted to the petitioner institute for conducting D.Ed The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. court (now D.El.Ed Programme) of two years duration with an annual intake of 50 students (one unit) from the next academic session i.e. 2023-24.

3. It has been noted that the petitioner has impugned this order before this Court but has not invoked the jurisdiction of the Appellate Committee.

4. Learned Senior Counsel for the petitioner submits that in view of the gravity of the situation, the petition has been filed directly before this Court. However, the Court considers that in the presence of a fully efficacious remedy, the petitioner should have first invoked the jurisdiction of the Appellate Committee.

5. Hence, the present petition is disposed of with the direction to the petitioner to approach the Appellate Committee. The Appellate Committed on receipt of such representation, shall decide the same within a period of 04 weeks and inform the petitioner.

6. In case of any grievances, the petitioner shall be at liberty to approach this Court. It is made clear that this Court has not gone into the merits of the case, and no expression made herein shall be tantamount to be an expression on the merits.
