O R D E R

The present application is filed seeking pre-arrest bail in case FIR No. 474/2019 dated 25.09.2019 registered at Police Station Paschim Vihar West for offence under Section 420 of the Indian Penal Code, 1860.

This Court by an order dated 28.03.2023, granted interim protection subject to the applicant joining and cooperating in the investigation. It is not disputed that the applicant has since joined the investigation as and when required.

It is alleged that some information was called from the applicant and he has failed to supply the same. 4.

On the last date of hearing, the applicant pursuant to the said allegation has also filed the details of his bank statements indicating the alleged transactions with the co-accused Saurabh Soni.

The allegation against the applicant was that he is the beneficiary of ₹15-16 lakh, which he had received from the co-accused Saurabh Soni. It is not disputed that the complainant had parted with the money after entering into alleged agreement with the co-accused Saurabh Soni. It is not denied that coaccused Saurabh Soni has already been admitted on regular bail. 6.

In view of the above, this Court is of the opinion that the custodial interrogation of the applicant is not required. The applicant, in the event of arrest, is directed to be released on bail on furnishing a personal bond for a sum of ₹50,000/- with two sureties of the like amount, subject to the satisfaction of the concerned SHO, on the following conditions:

a.

The applicant shall join and cooperate with the investigation, if required, as and when directed by the IO; b.

The applicant shall not leave the country without the prior permission of the learned Trial Court;

c.

The applicant shall not contact the complainant / witnesses or tamper with the evidence in any manner;

d.

The applicant shall appear before the learned Trial Court as and when directed;

e.

The applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/SHO;

f.

The applicant shall give their mobile number to the concerned IO/SHO and shall keep their mobile phones switched on at all times.

The present bail application is allowed in the aforesaid terms.
