The petitioner is seeking initiation of the contempt proceedings against the respondent/husband for continuous and wilful disobedience as well as reneging on an undertaking given before the Mahila Court in the Complaint Case No.423/2020 under Section 12 of the Domestic Violence Act, 2005.

No one is present for the respondent despite sending advance notice.

Learned counsel for the petitioner has alluded to the orders dated 28.09.2024, 24.10.2024 & 07.11.2024 passed in the Execution Case No.97/2024, whereby despite giving repeated undertakings, the respondent is not making the payment. After some arguments, the present petition is dismissed as withdrawn with liberty to the petitioner to seek execution of the orders passed by the Court concerned and seek attachment of the amount of the salary of the respondent in accordance with law. 7.

The learned Trial Court is impressed upon to ensure that the execution application is considered in right earnest and appropriate directions are passed for recovery of amount of maintenance which is payable to the petitioner.
