O R D E R
% 15.02.2019 CM APPL. 7220/2019 (exemption) Allowed, subject to just exceptions.
W.P.(C) 1560/2019 & CM APPL. 7219/2019 (stay) 1.
Petitioner has filed this writ petition in public interest and claims for the following reliefs:
"a.
Issue an appropriate Writ, Order or direction thereby, for inquiry into the actions of the Respondents and identifying
and reprimanding the concerned officials of the Respondents, indulging in corruption, malpractices and mal-administration; b.
Pass an order for preservation of all records pertaining to the Indian Railway Project Management Unit, till completion of inquiry;
c.
Pass such other and further Orders and/or directions as this Hon‟ble Court may deem fit, just and proper." 2.
The complaint filed by the petitioner pertains to grant of various contracts by the Railway Administration throughout the country right from the year 1995-96 or even much earlier. Taking note of the fact that challenge is to various contracts that have been granted for various works and periods throughout the country from 1995 to various other periods and the prayer made by the petitioner is to investigate all these contracts awarded and supervise it. It is the grievance of the petitioner that action on his complaints have not been properly taken, we are of the considered view that in a Public Interest Litigation such a roving enquiry cannot be ordered and we see no reason to make any indulgence into the matter in pursuance to the extraordinary jurisdiction available to us under Article 226 of the Constitution of India.
3.
The petition is, therefore, dismissed. The pending application also stands disposed of accordingly.
