% 04.02.2020 This writ petition is filed by the petitioner seeking directions for demolition of the fresh illegal construction being carried out by respondent No.4 and 5 at A16-17,G.T.Road, Adarsh Nagar, New Delhi-110033. Learned counsel who has entered appearance for respondents No.1 and 2 states that action has already been taken by the said respondents. A notice under section 343 and 344(i) of the DMC Act has already been issued on 20.1.2020 for deviation/excess coverage from basement to third floor. Copies of the said notices have been filed in court. They are taken on record. Learned counsel for respondents No.1 and 2 assures that proceedings shall be continued in accordance with law.

Taking the above statement on record, petition is disposed of. Respondents No.1 and 2 will ensure that proceedings initiated under section 343 and 344 (i) of the DMC Act are completed as per law within three months from today. In case there is a failure on the part of respondents No.1 and 2, liberty is granted to the petitioner to approach this court.
