% 03.02.2020 This petition has been filed by the petitioner praying for the following reliefs:
(a) Issue a writ, order or direction in the nature of certiorari to set aside the Show Cause Notice bearing No. Legal / ZALC2 /AM. 19 / CLA / 1366442, dated 17.09.2019 issued from the office of the Additional Director General OF Foreign Trade, Central Licensing Area, 'A' Wing, I.P. Bhawan, I.P. Estate, New Delhi-110002; and (b) Grant cost of the Petition."
The learned counsel for the petitioner submits that this Court by its order dated 18.03.2019 passed in WP(C) 1566/2019 had directed the respondents to take an informed decision on the application of the petitioner for redemption of Advance Authorization Licence issued to the petitioner.
Instead of deciding on the said application, the respondents have issued the Impugned Show Cause Notice dated 17.09.2019 alleging violation of policy provisions by the petitioner.
At the outset, it was put to the learned counsel for the petitioner that the decision on the Show Cause Notice would in fact have a bearing on the application of the petitioner seeking redemption of the Advance Authorisation Licence. The learned counsel for the petitioner insists that the petitioner does not require any hearing from the respondents on the issue of its application for Redemption of Advance Authorisation Licence. In view of the above concession, the respondents should comply with the order dated 18.03.2019 and pass an order on the application of the petitioner within a period of three weeks from today and without prejudice the Show Cause Notice which has been issued to the petitioner. The petition is disposed of in the above terms, with no order as to cost.
