1. Learned counsel for the Plaintiff states that in view of the settlement arrived at between the parties, Defendant No.1 has vacated the premises and handed over the possession to the Plaintiff. Learned counsel for the Defendant also confirms the said settlement.

2. In view of the above, since the matter has been settled, learned counsel for the Plaintiff wishes to withdraw the present suit. Parties shall be bound by the terms and conditions of the settlement arrived at between the parties.

3. Accordingly, the suit is dismissed as withdrawn in view of the settlement between the parties.
