The petitioner contends that he is the lawful owner of the plot property measuring 1-12 Bigha, bearing Khasra No. 684/2 (1-12) of Village Mandawali Fazalpur, East Delhi.

The petitioner contends that earlier acquisition proceedings were taken up, however, vide common order dated 09.02.2015, passed in Writ Petition 8830/2014 and Writ Petition 2026/2014, the same were declared to have lapsed. The petitioner, therefore, contends that as on date, he is the lawful owner of the subject property and is entitled to enjoy the same without any interference.

According to the petitioner, the officials of Delhi Urban Shelter Improvement Board (DUSIB) and Delhi Development Authority (DDA) have started interfering in the lawful enjoyment of the subject matter. 4.

A prima facie perusal of the facts and circumstances and the nature of the relief is sought which essentially relates to the protection of the petitioner's civil right qua the peaceful possession and enjoyment of the property in question, the Court finds that the petitioner should have filed a civil suit seeking the necessary injunction.

The possession of the petitioner and ownership etc. are all such issues which may not be gone into a writ jurisdiction. The Court, therefore, is not inclined to issue notice. The petition is, therefore, dismissed with liberty to take appropriate recourse in accordance with law.
